1. Scope
These terms apply to all orders placed by consumers in the online shop kamasana.shop with KAMASANA GLOBAL LTD, Office 19136, 182-184 High Street North, London E6 2JA, United Kingdom (“we”). A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession. Separate agreements apply to business customers (B2B); please contact b2b@kamasana.global.
2. Contracting party and delivery area
The contract of sale is concluded with KAMASANA GLOBAL LTD. We deliver to Germany and Spain (mainland and Balearic Islands; not to the Canary Islands, Ceuta or Melilla).
3. Conclusion of the contract
The presentation of products in the online shop is not a legally binding offer but an invitation to order. You can add products to the cart and start the ordering process with the “Check out” button. There you enter your details and choose the shipping and payment method. Before submitting, you can review all details and correct them using your browser's back function or by editing the cart. By clicking the order button (e.g. “Pay now”) you submit a binding offer to purchase the goods in your cart.
Immediately afterwards you receive an automatic email confirming receipt of your order. The contract is concluded with this order confirmation. When paying via PayPal or Klarna, the contract is concluded at the latest when the payment process is completed.
4. Contract languages and contract text
The contract languages are German, Spanish and English. We store the contract text and send you the order details and these terms by email. You can view these terms on this page at any time.
5. Prices and shipping costs
All prices are final prices in euros and include statutory VAT. Any shipping costs are shown on the “Shipping” page and in the checkout before you submit your order.
6. Payment
We offer the payment methods shown in the checkout, in particular credit card, Apple Pay, Google Pay, Shop Pay, Klarna and PayPal. Payment is due upon conclusion of the contract. Klarna's own terms apply in addition when paying with Klarna.
7. Delivery
We ship from our warehouse in Ontinyent (Spain). The delivery time is shown on the “Shipping” page and on each product and starts, for prepayment methods, on the day after receipt of payment, otherwise on the day after conclusion of the contract. If a product is unexpectedly unavailable, we will inform you without delay and refund any payments already made.
8. Retention of title
The goods remain our property until paid in full.
9. Right of withdrawal and voluntary returns
Consumers have a statutory right of withdrawal. Details are set out in our withdrawal information on the “Refund policy” page. In addition, we grant a voluntary right of return of a total of 30 days from receipt of the goods; you bear the direct cost of returning the goods. The statutory right of withdrawal remains unaffected.
10. Warranty
The statutory warranty rights apply. Please report obvious transport damage to the carrier where possible and inform us; this does not affect your statutory rights.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under product liability law. For slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
12. Applicable law
The law of the country in which you, as a consumer, have your habitual residence applies. Mandatory consumer protection rules of that country always remain applicable.
13. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. For questions or complaints, please contact care@kamasana.global.
